Anti-Spam Policy

By creating an account in Sellizer application (hereinafter referred to as the “Application”), the User agrees to use it in a manner consistent with the Sellizer Anti-Spam Policy, the content of which is presented below. The use of the Service is also subject to the applicable Terms and Conditions and Privacy Policy. Sellizer applies a zero tolerance policy towards spam and prohibits Users from sending unsolicited messages in any form while using the Service.

Legal requirements

Sellizer requires that all Users comply with the following legal requirements: the Act of 18 July 2002 on the provision of services by electronic means, the Act of 29 August 1997 on the protection of personal data, Directive 2000/31/EC of the European Parliament and of the Council of 8 June 2000 on certain legal aspects of information society services, in particular electronic commerce, in the Internal Market (Directive on electronic commerce), Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 concerning the processing of personal data and the protection of privacy in the electronic communications sector (Directive on privacy and electronic communications).

Spam - what is it?

Spam is an unsolicited commercial communication sent electronically, usually in large numbers. The term ‘unsolicited’ means that the recipient has not given his or her prior intended consent to receive such messages. The term “in large number” means that the message is sent as part of a larger group of messages, the content of which is identical. The term “spam” refers to the transmission, distribution or delivery, in particular in bulk, of unsolicited commercial communications by electronic means.

Verification

Subscribers can be added to your Sellizer account in two ways. Email addresses can be imported from a file or added to the list manually. In such a case, it is necessary to have the subscriber’s consent to the processing of his/her data. It is forbidden to send messages to people who have not agreed to receive them. Please note that the subscriber’s consent to the processing of data cannot be presumed or implied from the subscriber’s declaration of will with any other content. Such consent may also be revoked at any time.

In the course of using Sellizer, it is strictly forbidden for users to borrow and purchase e-mail addresses from third parties, as well as to obtain addresses through activities such as harvesting. The use of any automated solutions, software and scripts is strictly prohibited. It is permitted to store and manage data and to send electronic information only to those who have consented to receive it.

We reserve the right to verify the list of subscribers imported by the User in terms of quality, i.e. having the required permissions to send e-mails, correctness and timeliness of email addresses, the presence of spam-traps or errors in email addresses. A negative verification result entitles us to reject an imported list. If you import more than one email address, we also reserve the right to request that you send us a test delivery to some of your email addresses. The possibility of importing the entire list or sending messages to other email addresses from the list will depend on the results of the test mailing.

Message content

The user is obliged to include true and accurate information in the headers of the message, i.e. in the “From” and “To” fields, which must clearly identify the sender. The subject matter of the message may not be misleading as to the intention and content of the message. Messages may also not contain vulgar or illegal content.

Email address

You may only send messages from the e-mail accounts of which you are the owner (set up by yourself or authorized to use it).

Infringement of contract terms

You may not use the application to send unsolicited or spam e-mails. The e-mail address sellizer.pl and the Internet address of the service may not be used in mass mailing or on the website thus advertised. If you spam or otherwise use the Service illegally, we will take reasonable steps, such as immediately deactivating your account and notifying you of the practices of your Internet Service Provider or relevant authorities, with or without notice, in our sole discretion and subject to applicable law. Notwithstanding the above, the User is liable for all damages suffered by Sellizer and third parties in connection with the User’s failure to comply with the Anti-Spam Policy.
